The Department of Homeland Security (DHS) has requested a judge to dismiss a lawsuit related to the deportation of Kilmar Abrego Garcia, a national of El Salvador. Abrego Garcia, who was accused of being a member of the MS-13 gang, was detained in 2019. Despite denying his involvement in the gang, two judges concluded that he was an MS-13 member based on confidential information. Abrego Garcia was shielded from deportation to El Salvador due to fear of being targeted by MS-13’s rivals. However, he was deported after being arrested in what the Trump administration labeled an “administrative error.” He is currently held in El Salvador but has not been convicted of a crime.
